1. Acceptance of Terms

By creating an account, accessing, or using EdToolkit ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not access or use the Service.

2. Description of Service

EdToolkit provides AI-assisted educational planning and curriculum organization tools through dedicated applications: - **classroom.edtoolkit.com** — designed for independent educators, teachers, and small class operators. - **homeschool.edtoolkit.com** — designed for homeschool parents and family educators. The Service includes lesson planning, sequential unit design, curriculum outcome tracking, differentiation tools, formative quiz generators, rubric builders, and home education portfolio tracking.

3. Account Responsibilities & Eligibility

You are responsible for: - Providing accurate, truthful registration information. - Maintaining the confidentiality and security of your login credentials. - All activity that occurs under your authenticated account. - Ensuring that any classroom context or child profile details you provide comply with educational privacy standards and do not disclose unnecessary personal identifiers. You must be at least 18 years old to create an account. Accounts on the homeschool application are parent/guardian accounts only — children do not hold independent accounts or direct access credentials.

4. Acceptable Use Policy

You agree NOT to: - Use the Service for any unlawful, fraudulent, or harmful purpose. - Attempt to compromise, decompile, reverse engineer, or gain unauthorized access to our infrastructure or accounts. - Upload malicious code, viruses, or intrusive scripts. - Use AI-generated content in ways that violate academic honesty policies or professional teaching obligations. - Resell, white-label, or redistribute the platform software without explicit commercial authorization.

5. AI-Generated Content & Educational Responsibility

The Service utilizes advanced artificial intelligence models to assist in generating educational plans, worksheets, and assessment materials: - AI outputs are assistive recommendations. You, as the educator or parent, remain responsible for reviewing, adapting, and validating all materials for pedagogical suitability and accuracy before use with learners. - We do not warrant that AI-generated content is error-free, exhaustive, or aligned with specific regional testing requirements without teacher verification. - You retain ownership of all original curriculum plans, customizations, and user-authored content created through the Service.

6. Subscriptions, Payments & Merchant of Record

Some features of the Service require a paid recurring subscription: - **Merchant of Record:** All payment processing, invoicing, billing, tax calculation, and tax remittance are handled securely by our Merchant of Record partner, **Creem** (creem.io / Armitage Labs). When purchasing a subscription, your contract for payment processing and sale is with Creem. - **Recurring Billing:** Subscriptions (such as Teacher Pro or Homeschool Family) are billed on a recurring monthly basis unless cancelled. - **Cancellation:** You may cancel your subscription at any time via the Customer Portal in your account settings. Upon cancellation, your access remains active until the conclusion of your current prepaid billing period. - **Statutory Right of Cancellation (UK / EU):** Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, UK/EU consumers have a 14-day statutory right to cancel a digital subscription. If you access or use the digital service during this period, any refund may be subject to a proportionate deduction for the period of service provided. - **Price Changes:** We reserve the right to modify subscription pricing with at least 30 days' advance notice to active subscribers.

7. Data Protection, UK GDPR & Privacy

Your use of the Service is governed by our Privacy Policy, which details our data controller obligations, lawful bases under the UK GDPR and EU GDPR, data retention timelines, and your statutory rights to access, rectify, or erase your data.

8. Intellectual Property

- The Service, its underlying algorithms, application code, user interfaces, and brand marks are the exclusive property of EdToolkit. - You retain all rights and intellectual property in the specific lesson plans, teaching materials, and original content you author. - You grant us a limited, revocable license to host, store, and process your content solely as required to provide and operate the Service for you.

9. Account Termination & Right to Erasure

- You may delete your account and request complete erasure of your data at any time via in-app settings. - We may suspend or terminate accounts that breach these Terms or engage in abusive platform behavior. - Upon account deletion, all personal profiles, projects, and generated artifacts are permanently removed in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable UK and governing law: - The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. - We are not liable for any indirect, special, incidental, or consequential losses, or loss of profits, data, or goodwill. - Our aggregate liability arising from or related to the Service is limited to the greater of £50 or the total subscription fees paid by you in the 12 months preceding the claim. - Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of **England and Wales**. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory statutory consumer protections available in your country of residence.
